What are UCITS ETFs?

UCITS (Undertakings for Collective Investment in Transferable Securities) is a regulatory framework for European mutual funds and ETFs. For Indian investors, Irish-domiciled UCITS ETFs offer substantial structural advantages for international investing.

For US equity exposure, holding an Irish-domiciled UCITS ETF reduces internal fund-level US dividend withholding leakage from 25% (under the US-India treaty for direct holdings) to 15% (under the US-Ireland treaty). Furthermore, Irish UCITS ETFs are non-US situs assets, meaning they sit outside the scope of the 40% US Estate Tax that threatens non-resident holdings of US-domiciled securities exceeding $60,000.

Frequently Asked Questions

What is a UCITS ETF? +
UCITS stands for Undertakings for Collective Investment in Transferable Securities. It is a regulatory framework created by the European Commission that establishes strict standards for mutual funds and ETFs, ensuring high levels of investor protection. They are available globally and highly favored by international investors.
Why are Irish ETFs popular for Indians? +
Ireland has a comprehensive Double Taxation Avoidance Agreement (DTAA) with the US. When an Irish-domiciled ETF receives dividends from US underlying companies, US withholding tax is capped at 15% at the fund level, reducing internal leakage compared to the 25% treaty withholding rate applicable to direct Indian investors in US securities.
Do UCITS ETFs avoid US Estate Tax? +
Yes. Because Irish-domiciled UCITS ETFs are legally organized outside the United States, their shares are considered non-US situs assets. For non-US residents (including Indian investors), this places the holdings outside the scope of the 40% US Estate Tax that applies to direct US securities exceeding the $60,000 exemption threshold.
How do I buy UCITS ETFs from India? +
You can purchase them through international brokerages that offer access to the London Stock Exchange (LSE) or other European exchanges. Interactive Brokers (IBKR) is the most common platform used by Indian investors for this purpose, funded via the LRS.
Are dividends taxed differently? +
If you buy an "Accumulating" UCITS ETF, dividends are automatically reinvested inside the fund without ever hitting your brokerage account. This defers the tax liability, meaning you only pay capital gains tax in India when you eventually sell the ETF units.
