UCITS ETF Taxation for Indian Investors

Understand capital gains, dividends, estate tax, Schedule FA and other tax considerations before investing in UCITS ETFs.

Capital Gains on UCITS ETFs

UCITS ETFs are treated as unlisted foreign securities in India. Following the Finance (No. 2) Act 2024, short-term capital gains (held ≤ 24 months) are taxed at your marginal slab rate, and long-term capital gains (held > 24 months) are taxed at a flat 12.5% without indexation.

Dividend Taxation

Dividends from foreign ETFs are taxed at your marginal income tax slab rate in India. If the foreign country withheld tax, you may claim a Foreign Tax Credit (FTC) under the Double Taxation Avoidance Agreement (DTAA) by filing Form 67.

US Estate Tax and UCITS

If you hold US situs assets (like SPY or direct Apple stock) over $60,000, your heirs may face up to a 40% US Estate Tax upon your demise. Because Irish-domiciled UCITS ETFs are legally organized in Europe, they are non-US situs assets outside the scope of US estate tax.

Schedule FA Reporting

Indian residents classified as Resident and Ordinarily Resident (ROR) must disclose all foreign assets, including UCITS ETFs and foreign brokerage accounts, under Schedule FA of their ITR (ITR-2 or ITR-3). Non-Residents (NR) and Resident but Not Ordinarily Resident (RNOR) individuals are legally exempt from Schedule FA. For ROR taxpayers, non-disclosure falls under the Black Money Act and carries severe penalties (up to ₹10 lakh per undisclosed year).
